Orioles win, remain 1 game behind Yanks

BOSTON (AP) - The Baltimore Orioles' outstanding bullpen is a big reason they're vying for the AL East lead. And Jim Johnson is the biggest reason for the success of that bullpen.
Johnson set a franchise record with his major league-leading 46th save and the Orioles beat the Boston Red Sox 4-2 on Friday night to remain one game behind the first-place New York Yankees.
The record means "that we're winning and we're having a good season," he said. "That's all it really means right now."
Baltimore closers hadn't had much of a shot at the record of 45 set by Randy Myers in 1997, the last time the Orioles finished the season with a winning record. They had no more than 69 wins in any of the last four years. But now they're 86-64 with 12 games left.
"When you talk about the history of the Orioles, you've got everybody's attention. That's pretty long and deep," manager Buck Showalter said of Johnson's record, but "Jimmy's got other goals in mind."
Those goals are winning playoff games and the Orioles are in good shape to have a chance. They can reach the postseason by winning the division or with a wild-card berth. They lead Oakland by one game for the first AL wild-card spot after the Athletics lost to the New York Yankees 2-1 in 10 innings.
The Red Sox, meanwhile, are 68-84 and assured of their first losing season since 1997.
"We were even seeing for the first time ... Baltimore fans in Boston," Johnson said. "I've never seen that before, so it's pretty cool how things are changing."
Matt Wieters drove in three runs and was behind the plate for Johnson's record-setting save.
"Both are nice," he said. "It took me a second to click in. I think when I was walking to the mound I realized he just broke the Orioles save record so that's pretty cool to get to catch that one."
Jon Lester (9-13) lost for the first time in his 21 career starts against the Orioles. He had been 14-0, the longest winning streak against the Orioles franchise for a pitcher at the start of his career since at least 1901. It had been the longest current winning streak by an active pitcher against any team. But he's 0-1 in his last four starts against them, all Orioles victories.
"It was bound to happen sometime," Lester said. "They're playing good this year. They've always had a good offense. They're just putting everything else together."
Miguel Gonzalez (7-4) allowed two runs on seven hits with three strikeouts and one walk in 6 1-3 innings as the Orioles improved to 6-1 this season at Fenway Park. They lead the AL with 44 wins on the road.
"They've got some home run hitters in the middle of the lineup and their bullpen's been `shut down.' `' Boston manager Bobby Valentine said.
The score was tied 2-2 after five innings before the Orioles went ahead with two runs in the sixth.
Adam Jones walked with one out and scored on a double by Wieters. A wild pitch by Lester sent Wieters to third and Mark Reynolds drove him in with a single. Reynolds went 2 for 4 and is 15 for 34 in 10 games against Boston this year.
"Every time they scored we had an answer, it seemed like," Showalter said, "and Matt was in the middle of that."
Baltimore second baseman Robert Andino left the game in the ninth after being hit in the left ear flap by a fastball from Mark Melancon. He was scheduled to have a CAT scan.
The Red Sox took a 1-0 lead in the third on doubles by Daniel Nava and Pedro Ciriaco. Then Wieters got his first big hit of the night in the fourth with a two-run single with no outs. It drove in J.J. Hardy, who had singled, and Jones, who had doubled.
"He's done a good job in the past against me, getting the barrel of the bat on those cutters down and in," Lester said of Wieters.
Boston tied it in the fifth when Gonzalez retired the first two batters then allowed consecutive singles by Ciriaco, Scott Podsednik and Dustin Pedroia, who snapped an 0 for 18 slump.
The game was the start of the Red Sox's final homestand of a disappointing season. But they could have an impact on the postseason race with two home games each against Baltimore and Tampa Bay before they finish with three games at Baltimore and three at New York.
NOTES: The Orioles activated DH Jim Thome and LHP Troy Patton from the 15-day disabled list. ... The Red Sox recalled 3B Danny Valencia and RHPs Pedro Beato and Zach Stewart from Triple-A Pawtucket. ... Former pro wrestler George "The Animal" Steele, who wrestled at Fenway Park on June 28, 1969, threw out one of the ceremonial first pitches. Known for biting the turnbuckle when he wrestled, he appeared to bite the ball before throwing. The other ceremonial pitch was thrown by Jim Roosevelt Jr., grandson of President Franklin Delano Roosevelt, who gave his final campaign speech at Fenway on Nov. 4, 1944. ... Randy Wolf (2-0) is scheduled to pitch for the Orioles against Aaron Cook (4-10) on Saturday in the second game of the three-game series.

CAW Deal: Ford Workers Vote On Deal Over Weekend; GM Workers To Vote On Wednesday
TORONTO - Ford workers in Hamilton and Windsor, Ont., vote today on a four-year deal reached this week that has been endorsed by their union leadership.
Other Ford ratification meetings will be held Sunday in Windsor and Brampton, Ont.
The Canadian Auto Workers says the proposed contract would create new employment opportunities for hundreds of laid off workers and provide cost of living lump sum payments.
CAW President Ken Lewenza says despite the endorsement from union negotiators, it's up to rank-and-file members to decide.
Ratification meetings for General Motors employees on a tentative deal that will maintain 1,750 jobs that had been in question will be held next Wednesday in Oshawa, Ont.
The CAW says it hopes it's just days away from reaching an agreement with Chrysler, though Chrysler has been reluctant to follow a pattern deal reached with its rivals.
"I'm optimistic that within the next three or four days we can get the job done," Lewenza said Friday.
Lewenza said Chrysler is fully aware that following the pattern set by its American rivals is essential for the union.
"If it breaks down in any way, we'll give the 24-hours notice and we'll utilize the tool but I'm anticipating we won't need to do that in the next three or four days," he said.
The GM and Ford deals will see new hires paid a lower rate, $20.40 an hour, which equals 60 per cent of current base pay and progressing to full pay in 10 years, longer than the six years agreed upon in the last agreement.
They will also be converted to a hybrid pension plan, which is less burdensome to the company than the defined benefit plan that current employees receive.
All employees at both automakers will receive a $2,000 annual cost of living lump sum payment and a $3,000 ratification bonus.

WASHINGTON (AP) ? Mitt Romney, one of the wealthiest candidates ever to seek the presidency, paid nearly $2 million in federal taxes on $13.7 million in income that he and his wife reported last year, his U.S. returns showed Friday. That came to an effective tax rate of 14.1 percent, lower than millions of middle-income Americans but actually more than he had to pay.
Most of Romney's income was from investment returns. That is why his rate was lower than taxpayers whose income was mostly from wages, which can be taxed at higher rates.
Romney's taxes have emerged as a key issue during the 2012 presidential race with President Barack Obama. Romney released his 2010 returns in January, but he continues to decline to disclose returns from previous years ? including those while he worked at Bain Capital, the private equity firm he co-founded.
The Obama campaign and other Democrats have pushed for fuller disclosures, reminding the Republican candidate that his father, George Romney, released a dozen years of returns when he ran for president.
Overall, the Romneys' main tax return and separate forms for blind trusts totaled over 800 pages. The blind-trust income came from hedge funds and other complex investment vehicles. The couple also reported $3.5 million in income "from sources outside the United States," citing "various countries." Their forms included filings on holdings in Switzerland, Ireland, Germany and the Cayman Islands.
The Obama campaign accused Romney anew of profiting from millions invested overseas and "loopholes and tax shelters only available to those at the top."
Apparently hoping to resolve basic questions voters might have, the Romney campaign also released a letter from his accountants saying that in the 20 years prior to 2010 the Romneys paid an average annual effective rate of 20.2 percent, never lower than 13.66 percent. On average, middle-income families ? those making from $50,000 to $75,000 a year ? pay 12.8 percent of their income in federal taxes, according to Congress' Joint Committee on Taxation. But many pay a higher rate.
The former Massachusetts governor, whose wealth is estimated at perhaps $250 million, is aggressively competing with Obama for the support of middle class voters.
Obama's own tax return for last year showed that he and his wife, Michelle, paid $162,074 in federal taxes on $789,674 in adjusted gross income, an effective tax rate of 20.5 percent. Their income plunged from $1.7 million in 2010, with declining sales of the president's books. In 2009, the Obamas reported income of $5.5 million, fueled by the best-selling books.
The Romneys' tax bill could have been lower.
For the year, they claimed a deduction for $2.25 million of their $4.021 million in charitable contributions, said Brad Malt, trustee of the candidate's blind trust.
The Romneys gave $2.6 million in cash to the Church of Jesus Christ of Latter-day Saints, the documents show. They gave just over $2 million in non-cash charitable contributions ? including donations of stock holdings in Domino's Pizza, Dunkin Donuts and Warner Chilcott ? to a family trust.
They could have claimed more in deductions, Malt said, but the couple "limited their deductions of charitable contributions to conform to the governor's statement (n August, based on the January estimate of income, that he paid at least 13 percent in income taxes in each of the last 10 years."
Romney seemed to be painted into a corner by that statement, which came in reaction to Democratic Senate Majority Leader Harry Reid's claim to have heard that the Republican had paid no taxes in some years.
Romney will surely be reminded by the Democrats that he also said in August, defending his right to pay no more taxes than he owed: "I don't pay more than are legally due, and frankly if I had paid more than are legally due I don't think I'd be qualified to become president."
He appears to be physically qualified by any measure.
The campaign released a separate report Friday ? by Romney's longtime physician, Dr. Randall Gaz of Massachusetts General Hospital ? that said he is healthy and ready to meet the rigorous demands of the presidency.
The report said Romney's heart appears healthy, and he takes a baby aspirin and medicine to treat high cholesterol to help keep it that way. He doesn't smoke or drink. And his resting heart rate is a low 40 beats per minute, in the range of well-trained athletes and reminiscent of President George W. Bush, who also had a low resting rate.
Romney is 6 feet 1? inches tall and weighs 184 pounds.
As for his taxes, the Romneys' 2011 rate was slightly above the 13.9 percent effective rate they paid for 2010 when their federal tax bill was about $3 million.
They paid federal taxes of $1,935,708 on income of $13,696.951 for last year, according to the returns filed Friday with the Internal Revenue Service. They had obtained a filing extension beyond the usual April 15 tax deadline. His campaign earlier estimated that he would pay about $3.2 million in taxes for the year, well above the $1.9 million actually paid.
Most of Romney's income is from investments held in a blind trust, and campaign aides have stressed that he makes no decisions on how his money is invested.
Most of the income for the year came from investments, which are now generally taxed at 15 percent whereas the top marginal rate for income from wages is 35 percent.
The Romneys reported $6.8 million in capital gains, such as from the sale of stocks and other securities, and $6.37 million from dividends and taxable interest.
Romney's vast fortune and his long association with Bain Capital have been much discussed this year.
Several tax law experts said Friday that his newly released tax returns would not be much help in resolving critics' questions about his sprawling finances ? whether he used aggressive tax-deferral strategies, what might be the specifics and tax advantages of his numerous offshore investments, what was the source of his massive retirement account and what are the details behind his now-closed $3 million Swiss bank account.
Analysts said details about his investments could emerge only if Romney provided far more of his tax returns ? including files dating back to his years at Bain, the private firm he left in 2001. Romney, who initially refused to disclose any tax returns, has drawn the line at providing those from the past two years.
"All the important compliance and policy questions relating to Romney's personal tax matters relate to the past," said Edward D. Kleinbard, a law professor at the University of Southern California and former chief of staff of Congress' Joint Committee on Taxation. "The issue has never been Romney's 2011 tax return ? in fact, it is a distraction to the real issues."
Only multiple returns would provide details about Romney's $100 million retirement account and how it grew, Kleinbard said. He also earlier returns would be crucial in knowing how often he paid gift tax on family trusts.
Joseph Bankman, a Stanford University law school professor and expert on tax law, said, "It's the Bain years we'd really need to know to have a full assessment of his tax strategies." Bankman said that the 2010 and 2011 returns "only raised these questions, but they can't provide real answers."
The Romneys applied a $1.5 million tax refund to their 2012 estimated tax payments.
The couple reported $190,350 in book royalties and speaking fees. And Romney also reported $260,390 in income last year from serving on various boards of directors.
Republican vice presidential nominee Rep. Paul Ryan of Wisconsin and his wife Janna, whose returns were also released Friday by the Romney campaign, paid $64,764 in taxes on $323,416 of adjusted gross income in 2011, for an effective rate of 20 percent.
Just over half of their income came from Ryan's congressional salary. Other income flowed from rental real estate and other investments, including a trust inherited by Janna Ryan. They donated $12,991 to charity, including to the Boy Scouts of America

Obama, allies steal financial win over Romney in August
WASHINGTON (Reuters) - U.S. Democratic President Barack Obama and his allies scored a financial victory in August over Republican challenger Mitt Romney and his backers as they hit snags in the money race, financial disclosures showed Thursday.
The key pro-Obama outside spending group in a rare show of strength raised more money last month than the pro-Romney "super" political action committee (PAC) while Romney continued to raise more cash for the Republican National Committee than his own campaign, which campaign finance analysts say limits the scope of the funds' use.
With the November 6 election looming, the candidates' ability to sustain large grassroots operations and have flexibility for rapid response through TV advertising may prove crucial in the tight race.
Romney has since April relied on outside backers for more than half of his ads, an academic study found last week -- far more than Obama, whose campaign has been spending at a rapid clip on its vast infrastructure and ad buys.
But in August, Romney's key Super PAC backer -- Restore Our Future -- plowed through $21.2 million as its fundraising declined for the second month, disclosures filed with the Federal Election Commission showed.
That left the group with just $7.4 million in cash on hand, raising questions about how much of an ad-buying force it will be in the home stretch.
Bringing in $7 million in August, Restore Our Future -- whose attack ads on Romney's foes were key to his clinching the Republican nomination -- lagged the pro-Obama Priorities USA Action, which has long struggled to attract Democratic donors who generally disdain the Super PACs' unlimited fundraising.
The pro-Obama Super PAC marked its best fundraising month with a $10.1 million haul and had $4.8 million in the bank.
OBAMA'S ADVANTAGE
Restore Our Future, which declined to comment, kicked up its spending in August to try to counter Obama's well-funded campaign, whose ads dominated the airwaves in many parts of the country last month.
Romney himself raised $66.1 million in August, according to FEC filings. But the campaign spent $61.2 million and could not dip into a large chunk of its cash because a provision in U.S. campaign law walled it off until after his official nomination at the Republican convention in Tampa in late August.
In fact, because of the law, Romney wound up stretched for cash at the end of August and had to take out a $20 million loan to make it to the general election period.
Obama's campaign also continued to invest its cash at a fast pace in August -- spending $83.2 million and raising $84.2 million -- but it emerged with more in its own coffers than the Romney campaign.
The Romney campaign finished August with $50.4 million in cash on hand, while Obama's campaign had $88.8 million -- even though the Republican National Committee trounced the Democratic National Committee, FEC filings showed.
The DNC had just $7.1 million in the bank, compared with the RNC's nearly eight-fold increase in cash on hand to $76.7 million.
But election finance analysts say campaigns are the ones holding the most flexible cash, because it allows for spur-of-the-moment investments, for example, to instantly rebut the opponent's latest attack.
Parties, while vowing to spend every dime on their presidential candidate, do provide key support when it comes to mobilizing voters and grass-roots outreach but this year they have a $21.7 million cap on how much they can coordinate with campaigns. That limits, most importantly, their capacity for advertising, crucial way to reach voters.
Overall, Romney, RNC and the joint fund were $46.5 million ahead of Obama, DNC and their joint fund in cash on hand at the end of August, according to news releases and disclosures.
In total fundraising, the president and the DNC remained ahead, having raised a total of about $742 million this campaign season, compared with roughly $630 million raised by Romney for his campaign and the Republican Party, also according to news releases and FEC disclosures.
CROSSROADS
Romney stands to benefit from other independent groups that can raise and spend unlimited amounts. One is American Crossroads, a Super PAC and nonprofit co-founded by former George W. Bush aide Karl Rove.
In August, the group raised $9.4 million and had $32 million left in cash on hand, FEC filings showed.
Romney also benefits from two non-disclosing tax-exempt advocacy groups American Crossroads' sister group Crossroads GPS and Americans for Prosperity, funded by billionaire brothers Charles and David Koch.
Even so, the August totals - along with the independent Republican groups turning their focus to races for the U.S. Senate and House - could reflect some of the discontent that many conservatives feel toward Romney's campaign, which trails Obama's nationwide and in several of the politically divided "swing" states that will decide the election.
The academic Wesleyan Media Project last week found that 54 percent of pro-Romney or anti-Obama ads run between late April and early September came from independent groups.
Democratic groups, generally unable to match Republican groups' fundraising prowess this year, funded just 9 percent of ads benefiting Obama during that time.

Reader Poll: How do you take your coffee? - Food Lush
by Caitlin
My first real job (as in, not babysitting, but actually using my social security number and getting a fancy check) was working at a coffee shop. It helped fuel my burgeoning taste for coffee. I was 15. (Or 14? Maybe 14. I was on that job as soon as I was legally allowed to work.)
?
Hey, here's where I worked! Where my Rhode Islanders at? You know they've reopened a few locations? This picture was taken last summer.
I started drinking coffee regularly in high school, in part because of this job. Writing that out seems kind of crazy, but it didn't at the time. Coffee was cool. (I guess?) I took my coffee various ways in high school, but I distinctly recall that at one point I took it with (prepare to judge me) 8 sugars (OMFG) and half skim milk. Disgusting.?
It evolved over the years. I drank it in college with milk (occasionally cream) and a far more reasonable amount of sugar -- maybe a teaspoon or two. Out of school I continued to drink it this way. As the years went by I eventually cut out sugar completely. Somehow during this time, my husband went from using lots of sugar and dairy-free powdered creamer (ew.), to taking it black. I was in no way ready to drink my coffee black, and didn't see myself ever going there.?
You can see where this is going, yes? I now drink my coffee black, 90% of the time. I don't even really remember how it happened. I seem to recall slowly cutting back on the amount of milk in my cup and here I am. We make our coffee at home and between the two of us we drink a pot every day, black. I just LIKE the taste of coffee. Well, good coffee. If I get a coffee out and it's not that great, I add a splash of milk (and maybe a sugar, if it's iced).
As a kid I always remember my grandmother drinking her coffee black, and I just couldn't understand how anyone could do that. Does this mean I'm also going to start playing bridge and discussing my bursitis with anyone who'll listen???I guess our tastes really do change over time. That Bess Eaton iced coffee I had last summer after a ten year hiatus was nowhere near as good as I remember.
So readers, I'm curious. Tell me, how do you take your coffee? Has it changed over the years?

Challengers to Clovis-age impact theory missed key protocols, new study finds
An interdisciplinary team of scientists from seven U.S. institutions says a disregard of three critical protocols, including sorting samples by size, explains why a group challenging the theory of a North American meteor-impact event some 12,900 years ago failed to find iron- and silica-rich magnetic particles in the sites they investigated.
Not separating samples of the materials into like-sized groupings made for an avoidable layer of difficulty, said co-author Edward K. Vogel, a professor of psychology at the University of Oregon.
The new independent analysis -- published this week in the online Early Edition of the Proceedings of the National Academy of Sciences -- did, in fact, isolate large quantities of the "microspherules" at the involved sites where the challengers previously reported none. Lead author Malcolm A. LeCompte, an astrophysicist at Elizabeth City State University in North Carolina, said the findings support the climate-altering cosmic impact, but his team stopped short of declaring this as proof of the event.
The Clovis-age cosmic-impact theory was proposed in 2007 by a 26-member team led by Richard B. Firestone. That team included University of Oregon archaeologists Douglas J. Kennett and Jon M. Erlandson. While other groups have found corroborating evidence of a potential cosmic event, other groups reported difficulties doing so. One group, led by Todd A Surovell of the University of Wyoming, did not find any microspherule evidence at five of seven sites they tested, including two previously studied locations where Firestone reported large numbers of microspherules.
"In investigating the two common sites and a third tested only by Surovell's team, we found spherules in equal or greater abundance than did the Firestone team, and the reported enhancement was in strata dated to about 13,000 years before the present," LeCompte said. "What we've done is provide evidence that is consistent with an impact, but we don't think it proves the impact. We think there's a mystery contained in the Younger Dryas strata, and that we've provided some validation to the original research by Firestone's group."
The particles in question, the team concluded, are terrestrial as was claimed by the Firestone group, and not of meteoric origin as claimed by other challengers including Surovell's group, and are similar to metamorphic material in Earth's crust. That determination was made using electron microscopy and spectroscopy.
"These spherules have evidence of very high-temperature melting and very rapid cooling, which is characteristic of debris ejected from an impact," LeCompte said. Speherules would have melted at temperatures approaching 2,000 degrees Celsius (more than 3,000 degrees Fahrenheit), he added. Cosmic materials, including the some microspherules, regularly fall to earth from space due to meteorite ablation, but the spherules found in soils dating to 13,000 years ago are much different, he added. Other researchers had suggested that these spherules were deposited by a cosmic rain or resulted through slow, terrestrial processes occurring under ambient conditions.
LeCompte and some key collaborators wondered why Surovell didn't find any spherules, and that led them to Vogel. Many of the spherules investigated were tiny, ranging in size from 20 to 50 micrometers (microns); about the diameter of a human hair.
"The inherent difficulty in finding these small, relatively rare magnetic microspherules suggested there may be inherent limitations in human faculties that needed to be addressed, and that's how and why we sought out UO Professor Ed Vogel. His research into human cognitive capabilities proved so important in understanding both why the search was so difficult and why size-sorting was effective and important in making it easier," LeCompte said.
Vogel specializes in the ability of people to find specific items amid multiple distractions.
"A visual search is a very error-prone process," Vogel said. "This was a case of looking at millions of particles from which you are hoping to find something that might be present much less than 0.1 percent of the time." Size-sorting, he said, is vital because it is easier to find a target item with a characteristic shape and color when all of the many more-distracting objects are very similar. "It is a slow, tedious process to examine such quantities of materials with the human eyes when object sizes are extremely dissimilar."
"Science is only as good as the humans who conduct it, and this study shows how the minds of researchers can operate in some surprising ways," said Kimberly Andrews Espy, UO vice president for research and innovation, and dean of the graduate school. "Dr. Vogel's excellent work, which illustrates the importance of understanding how the human mind processes information and the consequences it can have beyond making everyday computations, reflects the University of Oregon's strengths in interdisciplinary research."
LeCompte described Surovell's study "as possibly the most damning of the reports that had challenged the original theory."
"Todd had worked very hard and couldn't find the spherules, but I think he made some fatal errors that need to be pointed out," LeCompte said. "It is instructive in that we initially made the same mistake and came to the same erroneous conclusion, but then we corrected our mistake. I would say this is a case of a missed opportunity due to their deviations from the protocol."
Two other critical protocol deviations not followed by the challengers involved the amounts of material examined and the use of microscopy techniques specified in Firestone's original research. Another two minor aspects of the protocol also were not repeated, reported LeCompte's team, which, in addition to Vogel, included an archaeologist, two materials scientists, a botanist, a periglacial geographer and an aerospace engineer.
LeCompte's team -- using the protocols of Firestone's group and electron microscopy -- additionally studied a quarry site in Topper, S.C., where Clovis-age people had made stone tools. After removing chert debris associated with tool making in soil at the depth of the Clovis occupation, LeCompte said, researchers observed virtually no spherules below it, while in soil just above the chert fragments they found a spike in the number of telltale spherules.
Further above that level, he noted, the soil layers were essentially "a dead zone" somewhat analogous to the K-T boundary, or "tombstone layer," from an extinction event that occurred 65 million years ago. At Topper, the dead zone showed almost no trace of human habitation for perhaps as long as 1,000 years duration.
"This suggests that something very dramatic happened," LeCompte said.
"The effects of such an impact would have been catastrophic on a global scale," said co-author Barrett Rock, a botanist at the University of New Hampshire. "On the order of 36 ice-age species became extinct, and the Clovis human culture eventually lost. All of this in response to dramatic changes in the vegetation at the base of the faunal food chain."

Massachusetts Elder Law Attorney | Successful Planning Under New
Massachusetts Elder Law Attorney | Successful Planning Under New Medicaid Laws
?Despite the numerous restrictions the Deficit Reduction Act of 05 (hereinafter DRA) has placed on Medicaid eligibility, elder law attorneys are still able to assist individuals and families in developing estate plans to avoid depleting their assets should they become ill and need long term care.
For those individuals who are already in a nursing home, despite the harsh new rules, elder law attorneys are continuing to help them qualify for Medicaid benefits while maximizing the amount of money they are able to keep.
Here are just a few examples of families we were able to assist port DRA enactment:
Bill came into our office in June. His wife, Diane, had entered a nursing home which was costing the couple over $12,000 each month. Not including their home, their total assets totaled roughly $500,000 at the time Diane entered the nursing home in April. Bill was told by the state that he could keep the couples? home as an exempt asset and then once they spent down to approximately $113,640, Diane would qualify for Medicaid.
We advised Bill that he could stop spending down immediately and he could purchase a ?Medicaid friendly annuity? with his portion of the assets, so long as the terms of the annuity conformed with the provisions under the new law.
The same month of our initial meeting, we put a Medicaid application on file. Shortly after filing the application, we received word that Diane was approved for benefits retroactive to the date of application. This saved Bill thousands of dollars!
Before purchasing an annuity, it is imperative that you consult with someone who understands the new criteria for annuities under the DRA. If structured improperly, the same annuity purchased by Bill could have resulted in a 40 month Medicaid penalty during which Diane would be ineligibly for Medicaid!
?***************
Cheryl met with our office in March to discuss the situation with her mother, Lois.
Cheryl moved in with her mother, Lois, a few years ago to help care for her. Last year Lois had a stroke and Cheryl quit her job to assist her mother full time. When Cheryl came to our office, it had gotten to the point that Lois needed more help than Cheryl could provide. The doctor told Lois it was no longer safe for her to live at home, even with Cheryl?s assistance. Lois, the doctor said, needed nursing home care.
Cheryl and Lois were concerned that Lois would have to sell her house to pay for her care and Cheryl would have no place to live. It was very important to Lois that she give her home to her daughter as a way of saying thank you for the care Cheryl had provided. But, both Cheryl and Lois had heard that gifting the home would cause her to be ineligible for Medicaid (and under the new DRA, the penalty wouldn?t even start until Lois applied for Medicaid and was otherwise eligible!)
Through some planning, we were able to transfer the home to Cheryl, without causing any Medicaid penalties for her mother. The same month Lois went into the nursing home, we applied for Medicaid included the transfer of the home on her application, and Lois was approved for benefits!
Gifting an applicant?s residence to a caretaker child continues to be available under the new DRA so long as the requisite proof is provided, including a doctor?s statement. Again, is the transfer is made improperly, the result could be up to five years of Medicaid ineligibility!
While the Deficit Reduction Act can make Medicaid planning and Medicaid crisis situations more difficult, they are certainly not impossible. Call our office today to discuss the specifics of your situation and find out what you can do to protect your family?s assets while getting high-quality care for yourself or your loved one.
